Construction and demolition of waste compliance
Introduction
The Construction and Demolition Waste Management Rules 2016 apply to all waste generated during the construction, remodeling, repair, or demolition of any civil structure by any individual, organization, or authority that generates construction and demolition waste such as building materials, debris, or rubble.
Every waste generator is responsible for the collection, segregation, and storage of construction and demolition waste created, as ordered or notified by the competent local authority in accordance with the Construction and Demolition Waste Management Rules 2016.
Waste generators who produce more than 20 tonnes of waste in a single day or 300 tonnes per project in a month must separate their waste into four streams: concrete, soil, steel, wood and plastics, bricks and mortar, and submit a waste management plan and obtain appropriate approvals from the local authority before beginning construction, demolition, or remodeling work.
Every waste generator must pay the relevant charges for collection, transportation, processing, and disposal as notified by the relevant authorities; waste generators who generate more than 20 tonnes of construction and demolition waste in one day or 300 tonnes per project in a month must pay for the processing and disposal of their waste, in addition to the payment for storage, collection, and transportation. The rate will be set by the local government or any other body designated by the state government.
Site Selection Criteria for Construction and Demolition Waste Storage, Processing, and Recycling Facilities
- The concerned department of the State Government in charge of land shall be responsible for locating suitable sites for the construction and demolition of storage, processing, and recycling facilities, and for handing over the sites to the concerned local authority for development, operation, and maintenance, which shall ultimately be given to the operators by the Competent Authority.
- According to Schedule I of the Construction and Demolition Waste Management Rules 2016, construction and demolition waste must be disposed of at a sanitary landfill for municipal solid waste in the city or region. Construction and demolition waste processing or recycling industry residues must be landfilled in a sanitary solid waste landfill.
- The following projects will be exempted from the environmental standards for dust and noise:
- For construction projects in which at least 80% of construction and demolition waste is recycled or repurposed in-situ and a sufficient buffer area is allocated to safeguard the surrounding inhabitants from any negative effects
