Hazardous waste compliance
After receiving hazardous waste authorization from the concerned State Pollution Control Board (SPCB)/Pollution Control Committee (PCC) for generation, collection, storage, transportation, reception, reuse, recycling, recovery, pre-processing, co-processing, utilisation, treatment, disposal, and incineration of hazardous waste, the occupier is required to fulfil the following responsibilities.
1. The following actions must be followed by an occupier for the management of hazardous and other wastes:
2. Hazardous and other wastes must be managed in a safe and environmentally sound manner by the occupier
3. Hazardous and other wastes generated in an occupier’s establishment must be delivered or sold to a registered actual user or disposed of at a registered disposal facility.
4. Hazardous and other wastes must be transferred in conformity with HWM Rules from an occupier’s establishment to an authorised actual user or an authorized disposal facility.
5. The occupier who wishes to have his or her hazardous and other wastes treated and disposed of by the operator of a treatment, storage, and disposal facility must provide the operator with all important details necessary for safe storage and disposal.
6. While managing hazardous and other wastes, the occupier must take all necessary precautions to-
A. Contain contaminants, avoid accidents, and minimise their impact on people and the environment; and
B. give adequate training, equipment, and information to anyone working on the site to ensure their safety.
Hazardous waste Compliance
Preparation of FORM 3 (Maintaining Records)
Every occupier authorised under Hazardous waste and waste management rules, must keep a Form 3 record of any hazardous and other wastes he manages.
Filling of Annual Return
On or before the 30th day of June following the financial year to which the return relates, every occupier authorized under these rules must prepare and submit to the State Pollution Control Board an annual return containing the details stated in Form 4 to the State Pollution Control Board(SPCB)/Pollution Control Committee (PCC)
Preparation of Transboundary Movement (Form 6)
The import of other wastes mentioned in Part D of Schedule III does not need the Ministry of Environment, Forest and Climate Change’s approval. The importer must, however, provide the appropriate information to the Customs authorities using Form 6, along with other papers in addition to those indicated in Schedule VIII, when appropriate.
Labeling of Containers of HWM
Any occupier handling hazardous or other wastes, as well as the operator of the treatment, storage, and disposal facility, must ensure that hazardous and other wastes are packaged in a manner that allows for safe handling, storage, and transportation, in accordance with the Central Pollution Control Board’s guidelines. Form 8 must be followed when labelling.
Manifest
The term manifest refers to a transportation document created and signed by the sender and authorised in compliance with HWM guidelines.
The waste sender must make seven copies of the manifest in Form 10 with the colour codes, and all seven copies must be signed by the waste sender.
